Terms and Conditions

Effective Date: February 2, 2025

These Terms and Conditions are a legal agreement that applies to your use of columbusfoamparties.com (the “Website”), as well as the purchase, sale, and consumption of products through the Website, through Party Pro Manager, our online booking tool, or through our sales representatives and/or party hosts (“employees”). By continuing to use our Website, or by approving an electronic event proposal through Party Pro Manager, you agree that such use or approval is legally sufficient consideration under these Terms and Conditions.

Changes to the Terms and Conditions

These Terms and Conditions are governed by the laws of the State of Ohio and are subject to change by Columbus Party Rentals LLC (referred to as “Columbus Party Rentals”, “Columbus Foam Parties”, “us”, “we”, or “our”) at any time, and at our sole discretion. We will use reasonable efforts to notify you of such changes. When changes are made to these Terms and Conditions, they become effective immediately when published unless otherwise noted. You should review these Terms and Conditions prior to ordering, obtaining, or receiving any service or product available through this Website, our employees, our sales representatives, or our online booking tool. 

Controlling Law

These Terms and Conditions and the rights of the parties shall be governed, construed, and interpreted in accordance with the laws of the State of Ohio and only Ohio courts shall have jurisdiction over any action or proceeding concerning the Agreement and/or performance thereunder.

Service Delivery

Certain portions of our Website, Party Pro Manager software, and online booking tool permit you to schedule services from Columbus Party Rentals LLC DBA Columbus Foam Parties. We may require a reasonable deposit at the time of scheduling, and a final payment prior to the delivery of service, which shall be non-refundable, except as allowed by our cancelation and refund policy. 

We reserve the right to change or substitute products or services offered for sale through the Website, online booking tool, and/or our sales representatives or technicians, the prices or specifications of the products or services, and any promotional offers at any time without any notice or liability to you or any other person. We reserve the right to modify, cancel, terminate, or not process orders, including those which have been accepted or for which deposits have been paid where the price or other material information on the Website or online booking tool is inaccurate, where we have insufficient labor, material, or equipment availability to fulfill an order, or for any other reason in our sole discretion. If we do modify, cancel, terminate, or not process an order, or perform service, we will either not charge you, or issue a refund of deposits or other monies paid to the payment type used in the order. 

Taxes

Party entertainment services are not taxable within the State of Ohio, however we may offer other products and/or services from time-to-time upon which we are legally required to collect Ohio sales tax. As a mobile service provider, the local sales tax rate shall be set based upon the dispatch location of the party host, equipment and/or vehicle(s) providing said service(s). The tax amount will be automatically added to your purchase price. On rare occasions where the tax rate charged may be incorrect, at any time for up to two years from your date of service, you may contact us for a refund of tax overages. The right to a refund is your exclusive remedy for sales tax errors. 

Payment Processing

We use a third-party payment processor to process your payment information, including your payment card data. Be aware that you may be subject to the third-party processor’s terms and your information may be subject to their privacy practices. 

General Release / Indemnity / Hold Harmless

Certain portions of our Website, Party Pro Manager software, and online booking tool permit you to schedule services from Columbus Party Rentals LLC DBA Columbus Foam Parties. By scheduling a party with Columbus Party Rentals LLC DBA Columbus Foam Parties, you (“client”) agree to take all necessary precautions regarding items rented/equipment, and to protect all persons and property from injury or damage. As the client, you agree to supervise all event guests and assume liability for ensuring all rules and safety precautions are followed. By scheduling a party, client agrees to defend, indemnify, and hold harmless Columbus Party Rentals LLC DBA Columbus Foam Parties, and its employees, affiliates, and/or contractors against any and all liability, claims, judgements, attorney fees, and costs of any kind and nature, including, but not limited to, property damage, injuries, or death to persons. By scheduling services provided by Columbus Party Rentals LLC DBA Columbus Foam Parties, the Client acknowledges and understands that play in or around foam entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing, or colliding, emotional injury, paralysis, distress, damage, or death to any participant. 

Damage / Injury

Neither Columbus Party Rentals LLC nor any of its employees shall be responsible for any temporary or permanent damage to property. This includes both above-ground and below-ground property or equipment damage, including, but not limited to grass, plants, animals, buildings, trees, pools, furniture, vehicles, utilities, or any other property. Additionally, we reserve the right to charge the client’s credit card for damages to equipment resulting from the careless or willful damage of same by clients or guests. Neither Columbus Foam Party Rentals LLC nor its employees assume any responsibility for injuries sustained on the client’s property or designated location. All liability for damages or injuries are the sole responsibility of the Client and/or host venue. Client agrees to defend, indemnify, and hold harmless Columbus Party Rentals LLC DBA Columbus Foam Parties, and its employees, affiliates, and/or contractors against any and all liability, claims, judgements, attorney fees, and costs of any kind and nature, including, but not limited to property damage, injuries, or death to persons.

Supervision of Minor Guests

Columbus Party Rentals LLC DBA Columbus Foam Parties requires a parent or responsible adult to be present at and in visual contact with any and all activities associated with the Foam Party or related services/activities provided by us. The parent or responsible adult must at all times provide supervision of the event. For events with more than 10 guests, a minimum of one adult must be present for every 10 minor guests. The supervision requires focused attention and intentional observation of children at all times. In the event supervision is not provided, Columbus Party Rentals LLC DBA Columbus Foam Parties will end the service and depart the location without opportunity for refund. 

Alcohol / Drugs

Alcohol may be served at your event or party; however, we reserve the right to refuse, cancel, or cut short any party or booking where alcohol is being served if we, at our discretion, deem the safety of our staff, equipment, guests, or participants is compromised in any way. Drug use of any sort will not be tolerated in or around party activities, employees, or equipment. Any observed use of illegal narcotics or legal narcotics used in an illegal manner may result in the termination of the party. For the purposes of this agreement, marijuana and/or THC-containing products, including edibles and vapes, will not be permitted. 

Photography, Videography, and/or Recording at Events

By hosting an event with Columbus Party Rentals LLC / Columbus Foam Parties, I agree that Columbus Party Rentals LLC, its affiliates, and vendors, may photograph, film, and/or otherwise record foam parties and related activities, including the host/client, host venue, and all party guests for educational, training, and/or promotional/marketing purposes. I fully release any said photographs and/or recorded media for distribution, publication, licensing, and/or reproduction. 

Notice of photography/recording will be posted on the rules and advisories signage near the foam cannon or tent. Said signage shall be considered sufficient notice, and by entering the event venue or premises, all guests waive and release any claims they may have related to the use of recorded media at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording of themselves, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media.

Clients / party hosts consent and agree to to notify all invited guests in advance of the event of possible photography, filming, and/or recording by Columbus Party Rentals LLC, and its affiliates or vendors during the party reservation process, and acknowledge understanding that all photography, filming and/or recording will be done in reliance on this consent. Any individuals not wishing to be photographed, filmed, and/or recorded should not attend the event. Clients or Party Hosts may check "no" and opt-out of this release at the time of event booking.

Individuals who have been previously photographed and/or video recorded at an event may request to have images or recordings of their likeness removed from future marketing materials at any time by contacting us at contact@columbusfoamparties.com and including a copy of the images and/or recordings and/or direct links to the media where their likeness is displayed, however they acknowledge that notice of photography/recording was displayed on the rules and advisories signage near the foam cannon or tent at the time of photography/recording, and participation in said event waived and released any and all claims related to use of the recorded event at the time of the event, including waiver of any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement, or any fees for use of such record media, and that the sole remedy shall be a reasonable attempt by Columbus Party Rentals LLC, its affiliates, and/or vendors to remove images or recordings of their likeness from future marketing materials upon receipt of request. 

Cancellation / Refund Policy

A $100 non-refundable deposit is due at the time of booking to reserve your party date and time, with the remaining balance due 10 days prior to your scheduled party. In the event that the remaining balance due has not been paid in full at least 10 days prior to the event, Columbus Party Rentals, LLC is entitled to the full deposit paid, and no refund shall be issued. 

Parties cancelled for any reason at least 10 days prior to the event date are eligible for a full refund, less the $100 non-refundable deposit. 

Parties cancelled less than 10 days, but more than 72 hours prior to the event date/time are non-refundable, but may be rescheduled one time without penalty, subject to availability. 

Parties cancelled less than 72 hours prior to the event date/time are fully non-refundable and may not be rescheduled. The party host scheduled for your event will receive full payment for their scheduled hours for your event.  
 

Weather Guarantee

Our weather guarantee allows customers to reschedule or cancel their party up to 24 hours prior to the scheduled start time and receive a full refund if the hourly weather forecast for the zip code of the party location, as reflected on weather.com, shows a 50% or greater chance of rain and/or a forecasted temperature below 62 degrees Fahrenheit at the scheduled start time of the foam party. This policy supersedes the cancel for any reason policy above.  
 

During periods of inclement weather, such as active or impending heavy rain, lightning, or high wind, Columbus Foam Parties, at its sole discretion, deserves the right to pause, cancel, postpone, or reschedule your foam party. If the party has already started and must pause or end early due to inclement weather at the sole discretion of the Columbus Foam Parties staff, a pro-rated refund schedule will apply.  
 

• If a      foam party operates for less than 15 minutes and must cancel the remainder      of the scheduled party time due to weather conditions at the discretion of      the Columbus Foam Parties staff, (employee), the client will receive a      full refund. 
• If a      foam party operates for 15 minutes or longer, but less than 50% of the      scheduled duration of the party, and must cancel the remainder of the      scheduled party time due to weather conditions at the discretion of the      Columbus Foam Parties staff (employee), the client will receive a 70%      refund.
• If the      foam party operates for at least 50%, but less than 75% of the scheduled      duration of the party, and must cancel the remainder of the scheduled      party time due to weather conditions at the discretion of the Columbus      Foam Parties staff (employee), the client will receive a 50% refund. 
• If the      foam party operates for at least 75% of the scheduled duration, but less      than the full scheduled time of the party, and must cancel the remainder      of the scheduled party time due to weather conditions at the discretion of      the Columbus Foam Parties staff (employee), the client will receive a 25%      refund. 

Parties paused, canceled, or postponed at the request or discretion of the client are ineligible for a refund, except as outlined above. 

Access to Water and Electricity

Foam parties require access to both water and electricity at the host venue for the event. A standard outdoor hose bibb and 3-pronged GFCI-protected electrical outlet with 15-amp, 120V service will be required within 50’ of event location. Please let us know in advance if there is any issue with availability of water or power at the site of the event. If proper electricity and/or water connections are not available upon arrival, we will not be able to set up the equipment and Client will be responsible for the full cost of the scheduled event, without refund. 

Tips/Gratuities

Any tips or gratuities paid by the Client are distributed directly to the host(s) or employee(s) assigned to work the event. Pre-paid and/or credit card tips or gratuities are distributed to employee(s) on the next payroll cycle following the event.
